The rules of the road.

1. Service description

Medicus provides telehealth video consultations with Dr Eltanin James, an HPCSA-registered General Practitioner. Consultations are conducted via encrypted video call through the Medicus website.

2. Eligibility

To use Medicus, you must:

  • Be physically located in South Africa at the time of the consultation. You will be asked to confirm this as part of the informed-consent step before payment.
  • Provide valid contact and identifying information: name, email, phone number (with country dialling code), date of birth, sex, South African ID number or passport number, and residential address (suburb, town or city, and province)
  • Not be experiencing a medical emergency (call 10177 or visit your nearest ER)

3. Booking and payment

Consultations cost R300 per session (20 minutes). Payment is processed securely through PayFast and must be completed before the consultation can proceed.

By booking a consultation, you agree to pay the stated fee. Your booking is confirmed once payment is successfully processed.

4. Cancellation and refunds

Rescheduling is not permitted within 120 minutes of the consultation start time. If you need to cancel or reschedule outside this window, please contact us.

Refund requests will be considered on a case-by-case basis. If the doctor is unable to attend the consultation, a full refund will be issued.

5. Informed consent

Before each consultation, you will be asked to provide informed consent. This includes acknowledgement of the nature and limitations of telehealth, data handling practices, and your rights. You may withdraw your consent at any stage, including during and, where applicable, after the consultation. Withdrawal does not affect the lawfulness of any processing carried out based on consent before the withdrawal.

6. Limitations of telehealth

Telehealth consultations are not a substitute for in-person medical care in all situations. The doctor cannot perform a physical examination via video call. If the doctor determines that an in-person visit is necessary, they will advise you accordingly.

Practitioner’s right to terminate. Dr James retains the right to end a virtual consultation at any time if she considers it inappropriate, unsafe, or clinically inefficient to continue. Where she does so, she may advise an in-person follow-up or refer you to an appropriate practitioner or facility.

Technology limitations.The Medicus platform may be affected by power loss, load shedding, internet or data failures, and other technical disruptions outside the practice’s control. You acknowledge these limitations and agree that Medicus is not liable for any inability to provide services arising from such events.

This service is not for medical emergencies. If you are experiencing a medical emergency, please call 10177 (ambulance) or go to your nearest emergency room immediately.

7. Prescriptions and sick notes

If clinically appropriate, Dr James will personally issue electronic prescriptions following your consultation. Prescriptions are issued via EMGuidance Script Prescriber, signed using an Advanced Electronic Signature (AES) effected by Dr James personally and not delegated, and sent directly to your chosen pharmacy. Where a prescription is issued electronically with an AES via EMGuidance, it may include medications across the schedules permitted under that platform; outside of EMGuidance, prescriptions are limited to Schedules 1 to 4.

Sick notes are issued electronically and are personally signed by Dr James in a manner that is authentic and attributable to her. They state that they were issued following a telemedicine consultation and are emailed directly to you.

Referral letters are issued where Dr James determines that you should be assessed or treated by another practitioner or facility. A referral letter is addressed to the receiving practitioner and contains the personal and health information reasonably necessary for the continuity of your care. By accepting these terms and the informed-consent form, you agree that this information may be shared with the receiving practitioner for that purpose.

Medical-aid claim invoices may be issued on request after a consultation. A claim invoice carries the practitioner’s identification, your patient details, the date and description of the service, the practitioner-determined ICD-10 diagnosis code(s) and tariff code, and the amount paid. Claim invoices are emailed to you for submission to your medical-aid scheme. Whether a specific claim is reimbursed is at the sole discretion of your scheme.

The decision to prescribe medication or to issue any documentation is at the sole clinical discretion of the doctor based on her assessment.

7a. How the platform works

For transparency, the booking and consultation flow on the Medicus website works as follows:

  • Landing page. Information about the practice and the option to start a booking.
  • Booking page.Select a date and time from the available slots in the doctor’s calendar.
  • Patient details page. Enter your name, email, phone number (with country dialling code), date of birth, sex, South African ID or passport number, residential address (suburb, town/city, province), and reason for visit. Your email is verified with a one-time code before the booking is reserved.
  • Consent and payment. Review and consent to the informed-consent terms, then complete payment via PayFast.
  • Video consultation. At the appointment time, join the consultation via the secure link emailed to you.
  • Optional review. After your consultation, you can use a private link emailed to you to leave a short review of your experience. Reviews are optional.

8. Your responsibilities

You agree to:

  • Provide accurate and truthful information
  • Ensure you have a stable internet connection, camera, and microphone
  • Be in a quiet, private space for the consultation
  • Attend the consultation at the scheduled time
  • Not record the consultation without the doctor's consent

9. Intellectual property

The Medicus name, logo, and website content are the property of Medicus. You may not reproduce, distribute, or create derivative works from any content on this site without permission.

10. Limitation of liability

Dr James will exercise professional care and skill during your consultation. However, to the maximum extent permitted by law, Medicus shall not be liable for any indirect, incidental, or consequential damages arising from the use of this service.

Where reasonable security safeguards have been implemented, Medicus shall not be liable for any loss, damage, or harm arising from a data breach caused by a third-party service provider failure or cyber attack.

This does not limit any liability that cannot be excluded under South African law, including liability for negligence.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.

12. Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of the service after changes constitutes acceptance of the updated terms.
